PYNGUP Terms of Service

§ 1 Scope

These Terms of Service apply to all services of PYNGUP, provided by:

§ 2 Beta Test Version

PYNGUP is currently provided as a beta version. As a beta tester, you agree that:

• The software is in development phase
• Features may change or be removed at any time
• Technical problems or data loss may occur
• The service is free during the beta phase
• Feedback and improvement suggestions are welcome

§ 3 User Eligibility

Use of PYNGUP is open to natural persons aged 16 and older. For users under 18 years of age, consent from legal guardians is required.

§ 4 User Account

Registration is required for use. The user undertakes to:

• Provide truthful information
• Keep access credentials confidential
• Prevent misuse of their account
• Notify us immediately of any misuse

§ 5 User Obligations

The user undertakes to:

• Use the software only for legal purposes
• Not publish offensive, discriminatory or unlawful content
• Respect the rights of third parties
• Not distribute viruses or harmful software
• Not overload or manipulate the system

§ 6 Availability

We strive for high availability of the software. However, due to the beta phase, interruptions may occur. There is no claim to availability.

§ 7 Privacy

The protection of your data is important to us. Details about data processing can be found in our Privacy Policy.

§ 8 Limitation of Liability

During the beta phase, we assume no liability for:

• Data loss or technical problems
• Damage caused by system failures
• Content or actions of other users
• Indirect or consequential damages

This does not apply to damages resulting from injury to life, body or health or from the violation of essential contractual obligations, as well as to damages based on intentional or grossly negligent breach of duty.

§ 9 Termination

The beta program can be terminated by either party at any time without giving reasons. In case of violations of these Terms of Service, we may immediately block access.

§ 10 Copyright

All rights to PYNGUP are ours. You receive only a simple, non-transferable right of use for the duration of the beta test.

§ 11 Changes to Terms of Service

We reserve the right to change these Terms of Service. Users will be informed of changes by email. Objection is possible within 30 days.

§ 12 Final Provisions

German law applies. Place of jurisdiction is Dortmund, Germany. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
